Service Terms

A registered trade name of Tamar Cove Engineering, LLC

At MissionFirst Web Design Agency, we believe nonprofits and mission-driven organizations deserve clear, professional service. These Service Terms explain how we work with clients, what’s included in our website services, and what to expect during and after your project. By using our services or continuing to engage with us, you agree to these terms.

1. Scope of services

We provide full-service web design, development, and hosting for nonprofits and similar organizations. Our services typically include:

  • Custom website design and mobile-responsive development

  • Guidance or support with collecting and formatting content

  • Branding alignment (colors, fonts, layout)

  • Secure hosting, maintenance, and content updates

  • Support for nonprofit-specific features like events, donation tools, and mailing list integrations

  • Optional add-on services such as SEO, graphics, CRM integrations, and training

Deliverables will be outlined at the start of each project. Additional requests beyond the agreed scope may require a written change order and added fees.

2. Client responsibilities

To ensure timely and successful delivery, clients agree to:

  • Provide content (text, images, logos) in a timely and organized manner

  • Respond to approval requests and communication checkpoints

  • Review and approve deliverables promptly

  • Secure appropriate licenses or permissions for any third-party materials provided

If content is delayed, placeholder materials may be used to maintain project momentum.

3. Revisions & approvals

Each project includes a defined number of revision rounds, agreed upon during onboarding. A “revision round” includes a consolidated set of change requests. We recommend gathering all edits at once to avoid unnecessary delays.

Revisions beyond the included rounds—or late-stage changes that alter design or scope—may incur additional fees.

We follow a three-stage review process:

  1. Initial concept & strategy approval

  2. Full design draft review

  3. Final website review & pre-launch check

Final client approval is required before the website is launched.

4. Hosting & maintenance

All websites we build are hosted on our fully managed platform. Hosting includes:

  • U.S.-based hosting with automated backups and uptime monitoring

  • Ongoing software and plugin updates

  • Domain-based email accounts (reasonable usage applies)

  • Website content updates performed by our team

  • Technical support for included features

  • Use of premium plugins, where applicable

Self-hosting is not supported unless specifically agreed upon. If hosting is terminated, premium features provided through our licenses may no longer be available.

5. Intellectual property & licensing

  • All custom design and code remain the intellectual property of Tamar Cove Engineering, LLC unless stated otherwise in writing.

  • Clients are granted a non-transferable, non-exclusive license to use the completed website for their organization.

  • Licensed software (plugins, themes, tools) may be included as part of our service, but may not transfer if hosting ends.

  • We reserve the right to display completed client work in our portfolio unless a written confidentiality agreement is in place.

6. Delays, paused projects & cancellations

If content or feedback is delayed beyond agreed milestones, projects may be paused. A reactivation fee may apply for dormant projects.

If a project is canceled after work begins, the client is responsible for payment proportional to work completed.

Hosting services are billed separately and renew automatically unless canceled in writing with 30 days’ notice.

7. Accessibility & legal compliance

We make a good faith effort to follow WCAG 2.1 accessibility guidelines in our design process. However, ultimate responsibility for compliance with accessibility laws, data privacy, IRS nonprofit regulations, and any other legal obligations rests with the client.

We are happy to implement accessibility tools or audits by request.

8. Limitations & disclaimers

  • We do not guarantee uninterrupted uptime or specific SEO rankings.

  • We are not responsible for content or site changes made by the client or third parties after launch.

  • We do not offer legal, tax, or financial advice unless otherwise agreed in writing.

9. Refunds & cancellations

MissionFirst Web Design Agency provides custom web design, development, and hosting services tailored to each nonprofit client. Due to the personalized nature of our work, all sales are considered final once a project has begun.

Project deposits and milestone payments
If a project is canceled after a deposit has been paid:

  • The deposit is non-refundable

  • Any milestone payments already made are considered earned based on the work completed

  • If additional work has been completed beyond the last payment, a final invoice may be issued to cover that balance

We aim to be fair and transparent. If cancellation becomes necessary, we will work with you to settle the account based on the project’s progress at the time of termination.

Hosting services
Hosting is billed in advance and requires a minimum one-year commitment. After the first year:

  • Hosting may be canceled with 30 days’ written notice

  • No refunds will be issued for unused time in an active billing cycle

  • Premium features provided through our licenses (such as plugin access) may be discontinued after cancellation

Digital products (if applicable)
If we offer downloadable products or templates in the future, those sales will be final and non-refundable unless otherwise stated at the time of purchase.

10. Acceptance of terms

By using our services, accessing a website we’ve built or hosted, or continuing communication with us about your project, you agree to the terms outlined on this page. If you have questions or concerns, please contact us before proceeding with a new or ongoing service.
